Traffic offence? This is one of the most common interactions the public will have with the legal system in Canada. The most common charges are speeding, Drive Under Suspension, No Insurance, and Carless Driving. Speeding if you are convicted 1 to 15 km there are low fines and no points. If you are convicted 16km to 30km fines can be as much as $300 and 3 points. From 31 km to 49 km the fines can be as high as $500 and 4 points. Over 50km (Stunt Driving) Immediate roadside suspension for 7 days. seizure of the vehicle, For a first offence of stunt driving or racing, the penalty includes a minimum Fine of $2,000 to a maximum of $10,000. Possible Licence suspension up to 2 years (Second Offence – up to 10 years Licence Suspension) and a possible jail sentence up to 6 months. No insurance carries a fine of $5000 to 10,000 and Drive under suspension if convicted carries a penalty of 6 months suspension and up to a $5000 fine. At Rybowski Legal over 80% of my practice deals with this kind of defence. It is important if you chose to defend yourself you become aware of the law and the P.O.A. court rules. In most cases you may get a resolution which will mean that you pleaded guilty to a lesser charge but you do have to be aware of the pitfalls. Most people are concerned about their insurance however this can be the most minor issue you are dealing with. When charged it is always advisable you get legal advice from a licensed Paralegal or a lawyer. Remember you decision can affect you for years do not make a mistake. I offer a free consultation call before you decide.
