When you are charged with an offence regardless of it being Traffic or Criminal in a lot of cases but not all the officer is correct. This however does not mean you are in the wrong. For example let’s say you are charged with Stunt driving meaning you are going 50 k.m. over the speed limit. I was in Woodstock court today. I was defending a speeder who was caught in Hwy 401 last October. I noticed that there was a fatal error on the ticket. Once I saw this I brought it to the attention of the court, argued that the ticket was not valid and the JP agreed and quashed the ticket. My client did not have to plea guilty or do the trial and no convection was recorded.
